The tampering impeded investigations into whether Ojwang was tortured and killed in the police station cells, according to the court. Njihia requested that the matter be heard in private in a miscellaneous application, citing the sensitive nature of the ongoing investigation into Ojwang's "gruesome murder." The court granted part of the request — allowing 14 days of detention instead of the 21 sought by investigators.
Njihia informed the court that the suspects' mobile phones had been seized and would be subjected to forensic analysis. He added that the second suspect was taken into custody on June 14, 2025, near the Central Police Station, and booked at Kilimani. IPOA says that the technician and others who are still at large are thought to be trying to cover up the attack that killed Ojwang while he was in custody. During the heinous incident, it is alleged that the second suspect was inside the cells. While the suspects are said to have cooperated with investigators so far, Njihia told the court that more time is needed to complete forensic examinations and receive guidance from the Office of the Director of Public Prosecutions (ODPP) on how to proceed.
Both suspects were ordered held at Kilimani Police Station for 14 days until the investigation was finished.
